Terms of Service

These Terms govern your use of the Olum Service provided by XQ Ventures Ltd (“Olum”, “we”, “us”). By creating an account or using the Service, you agree to these Terms.

Eligibility

You must be at least 18 years old to use the Service.

What Olum is — and is not

Olum is an educational and wellness program based on cognitive behavioural therapy (CBT) principles and related techniques, designed to help you reduce the distress and reactivity associated with tinnitus. Olum is not a medical device, does not provide medical advice, diagnosis, or treatment, and is not a substitute for professional healthcare. It does not claim to cure, silence, or stop tinnitus. Please read our Medical Disclaimer, which forms part of these Terms.

Your account

You are responsible for the activity on your account and for keeping access to your email secure (sign-in uses magic links sent to your email). Tell us promptly at xav@witholum.com if you suspect unauthorised use.

Subscriptions, billing, and renewal

• The Service is offered on a subscription basis. The available plans and current prices are shown at checkout.
• Subscriptions renew automatically at the end of each billing period (monthly or annually, depending on your plan) at the then-current price, unless you cancel before the renewal date.
• Payment is processed by Stripe. By subscribing, you authorise us (via Stripe) to charge your payment method for the applicable fees, including renewals, until you cancel.
• If a free trial is offered, the terms of that trial (including its length and what happens when it ends) will be presented to you at sign-up. Unless stated otherwise, your subscription begins and billing starts when any trial ends.

Cancellation and refunds

You can cancel at any time from your account, which stops future renewals. Cancellation and our money-back guarantee are described in our Refund & Cancellation Policy, which forms part of these Terms.

Acceptable use

You agree not to misuse the Service, including by copying, redistributing, or reselling its content; attempting to access it unlawfully; or interfering with its operation or security. The program content and audio are licensed to you for personal, non-commercial use only.

Intellectual property

All content in the Service — including audio, text, designs, and software — is owned by or licensed to XQ Ventures Ltd and protected by law. We grant you a limited, personal, non-transferable, revocable licence to access it while your subscription is active.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind to the fullest extent permitted by law, including any implied warranties of merchantability, fitness for a particular purpose, or that the Service will be uninterrupted, error-free, or produce any particular result. Outcomes vary between individuals.

Limitation of liability

To the fullest extent permitted by law, XQ Ventures Ltd will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of the Service. Nothing in these Terms excludes liability that cannot lawfully be excluded (for example, for death or personal injury caused by negligence, or for fraud). Where liability cannot be excluded but can be limited, our total liability is limited to the amount you paid us in the 12 months before the claim.

Termination

You may stop using the Service at any time. We may suspend or end access if you breach these Terms or to protect the Service or other users.

Governing law

These Terms are governed by the laws of England and Wales, without regard to conflict-of-laws rules, and subject to any mandatory consumer protections available to you where you live.

Changes

We may update these Terms. We will post the updated version with a new effective date and, where appropriate, notify you. Continued use after changes means you accept them.
